Terms and Conditions
1.
The Contract Between Us
We must receive payment of the whole of the price for the goods that you
order before your order can be accepted. Once payment has been received,
our acceptance of your order (i.e. the goods are not out of stock) brings
into existence a legally binding contract between us. We will contact
you if we are unable to accept your order for any reason.
2.
Price
2.1 The prices payable for goods that you order are as set out in our
website.
2.2 You will be required to pay extra for delivery in certain circumstances,
as stated in our website, and it may not be possible for us to deliver
to some locations.
3.
Right For You To Cancel Your Contract (Except Made-to-Measure)
3.1 You may cancel your contract with us for the goods you order at any
time up to the end of the seventh working day from the date you receive
the ordered goods. You do not need to give us any reason for cancelling
your order nor will you have to pay any penalty.
3.2 To cancel your order you must notify us in writing.
3.3 If you have received the goods before you cancel your order then you
must send the goods back to our contact address at your own cost and risk.
If you cancel your order but we have already processed the goods for delivery
you must not unpack the goods when they are received by you and you must
send the goods back to us at our contact address at your own cost and
risk as soon as possible.
3.4 Once you have notified us that you are cancelling your order, any
sum debited to us from your credit card will be re-credited to your account
as soon as possible and in any event within 30 days of your order provided
that the goods in question are returned by you and received by
us in the condition they were in when delivered to you. If you do not
return the goods delivered to you or do not pay the costs of delivery,
we shall be entitled to deduct the direct costs of recovering the goods
from the amount to be re-credited to you.
3.5 Your right to cancel an order does not apply if the goods you have
ordered are Made-to-Measure items.
4.
Cancellation By Us
4.1 We reserve the right to cancel the contract between us if:
4.1.1 we have insufficient stock to deliver the goods you have ordered
and will not be receiving further supplies to go onto back order
4.1.2 we are unable to deliver to your area, or
4.1.3 one or more of the goods you ordered was listed at an incorrect
price due to typographical error or an error in the pricing information
received by us from our suppliers.
4.2 If we do cancel your order we will notify you by email and will re-credit
to your account any sum deducted by us from your credit card as soon as
possible but in any event within 30 days of your order. We will not be
obliged to offer any additional compensation for disappointment suffered.
5.
Delivery Of Goods To You
5.1 We will deliver the goods ordered by you to the address you give us
for delivery at the time you make your order.
5.2 Delivery will be made as soon as possible after your order is accepted
and in any event within 30 days of your order (except in the case of certain
Made-to-Measure or special order items, which will be as stated by us
after the order was placed).
5.3 You will become the owner of the goods you have ordered when they
have been paid for and delivered to you. Once goods have been delivered
to you they will be held at your own risk and we will not be liable for
their loss or destruction.
6.
Liability
6.1 If the goods we deliver are not what you ordered or are damaged or
defective or the delivery is of an incorrect quantity, we shall have no
liability to you unless you notify us in writing at our contact address
of the problem within 10 working days of the delivery of the goods in
question.
6.2 If you do not receive goods ordered by you within 30 days of the date
on which you ordered them (or in the case of certain Made-to-Measure or
special order items – within 30 days of the delivery date quoted),
we shall have no liability to you unless you notify us in writing at our
contact address of the problem within 40 days of the date on which you
ordered or in the case of certain Made-to-Measure or special order items,
within 40 days of the date on which you expected to receive the goods.
If you notify a problem to us under this condition, our only obligation
will be, at your option:
6.2.1 to make good any shortage or non-delivery;
6.2.2 to replace or repair any goods that are damaged or defective; or
6.2.3 to refund to you the amount paid by you for the goods in question
in whatever way we choose.
6.3 Save as precluded by law, we will not be liable to you for an indirect
or consequential loss, damage or expenses (including loss of profits,
business or goodwill) howsoever arising out of any problem you notify
to us under this condition and we shall have no liability to pay any money
to you by way of compensation other than to refund to you the amount paid
by you for the goods in question under clause 6.2.3 above.
6.4 You must observe and comply with all applicable regulations and legislation,
including obtaining all necessary customs, import or other permits to
purchase goods from our site. The importation or exportation of certain
of our goods to you may be prohibited by certain national laws. We make
no representation and accept no liability in respect of the export or
import of the goods you purchase.
6.5 Notwithstanding the foregoing, nothing in these terms and conditions
is intended to limit any rights you might have as a consumer under applicable
local law or other statutory rights that may not be excluded nor in any
way to exclude or limit our liability to you for any death or personal
injury resulting from our negligence.

Notices
Unless otherwise expressly stated in these terms and conditions, all notices
from you to us must be in writing and sent to our contact address at Style
Home Interiors, Challenge House, 616 Mitcham Road, Croydon, CR0 3AA and
all notices from us to you will be displayed on our website from time
to time.
8.
Events Beyond Our Control
We shall have no liability to you for any failure to deliver goods you
have ordered or any delay in doing so or for any damage or defect to goods
delivered that is caused by any event or circumstance beyond our reasonable
control including, without limitation, strikes, lock-outs and other industrial
disputes, breakdown of systems or network access, flood, fire, explosion,
accident or extreme weather.
9.
Invalidity
If any part of these terms and conditions is unenforceable (including
any provision in which we exclude our liability to you) the enforceability
of any other part of these conditions will not be affected.
10.
Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
11.
Third Party Rights
Except for our affiliates, directors, employees or representatives, a
person who is not a party to this agreement has no right under the UK
Contracts (Rights of Third Parties) Act 1999 to enforce any term of this
agreement but this does not affect any right or remedy of a third party
that exists or is available apart from that Act.
12.
Governing Law
The contract between us shall be governed by and interpreted in accordance
with English law and the English courts shall have jurisdiction to resolve
any disputes between us.
13.
Entire Agreement
These terms and conditions, together with our current website prices,
delivery details, contact details and privacy policy, set out the whole
of our agreement relating to the supply of the goods to you by us. Nothing
said by any sales person or by any other member of our staff on our behalf
should be understood as a variation of these terms and conditions or as
an authorised representation about the nature or quality of any goods
offered for sale by us. Save for fraud or fraudulent misrepresentation,
we shall have no liability for any such representation being untrue or
misleading. By placing an order with us you will be deemed to have agreed
that you have not placed any reliance on anything said by any sales person
or other member of our staff.

Language
The
only language in which an order may be placed and accepted is English.
We apologise for any disappointment that this may cause.

How
to Order
Everything
you need to consider when ordering a curtain pole, especially a Made-to-Measure
pole is detailed below. You may find it useful to print this page for
future reference.
Checklist
1.
Which diameter pole do you require? The main things to consider
here are what effect you are trying to create and how heavy your curtains
are. There are four main classifications of curtain weight and a rough
guide is as follows (if unsure, please err on the side of caution):
- Light
weight curtains - this includes voiles, sheers and thin fabrics
(some shorter curtains with lightweight fabrics and a lightweight lining
will fall into this category)
- Medium
weight curtains - this includes most ordinary lined curtains
(except for heavier or thicker fabrics such as velvet or some very long
and wide lined curtains)
- Heavy
weight curtains - this includes heavy fabrics, some longer
length lined curtains (where the fabric may not be heavy but there is
a full drop from the top of a high window to the floor, which adds significantly
to the overall curtain weight), lined curtains for wide windows and
many curtains with both lining and interlining
- Very
heavy curtains - this includes the extreme end of the scale
where the curtain fabric is very heavy and the curtain is lined, interlined
and possibly long and/or wide.
2.
What colour or finish would you like? The colours of poles illustrated
on this site may vary slightly with those of the finished products. This
is due to a mixture of the effects of photography and viewing on different
screens. If you are in any doubt or have not noticed these poles in shops
you may have visited, please request a sample of the colour you are interested
in, before placing your order. This is especially important for Made-to-Measure
products because we cannot accept returns unless faulty.
Please
also note that wood is a natural product and its appearance can vary.
Small colour variations may occur as a result of a particular batch of
wood of one type being naturally slightly darker or lighter, or with the
grain moving in a different direction. It will therefore not always be
possible to obtain an absolutely perfect colour match every time - even
with bespoke poles.
3.
Do your pole measurements include the length of the finials?
For Made-to-Measure orders, please confirm the length of the pole that
you require, excluding finials. Pre-packed poles such as Devon or Mercury
can be cut to precise lengths at home.
4.
Which finials do you require? Please remember to check the option
that you require, otherwise you will receive whichever finial is at the
top of the list.
MADE
TO MEASURE BLINDS
BLIND WIDTHS
We make the blind widths to your exact measurements. Make sure you have
deducted at least 1.5cm for clearance on the width if the blinds are going
inside of the recess of the window. Take the measurements at the narrowest
point on the width (you may have tiles on the bottom half of your window
recess) then deduct for clearance. Blinds are supplied to your specific
width both trimming both sides. The nature of this product means that
the cannot be laser straight and can vary up to 5mm down the length.
As these products are made to meaasure they cannot be returned under
our normal terms and conditions.
IMPORTANT NOTE - COLOUR
The blind colours are represented the best they can on your screen. Slight
colour variations in the wood grain may occur. As with all natural wood
products, variations in grain, texture and shade, along with some slight
warpage may occur. These are natural characteristic of real wood blinds
and we cannot accept returns based on any of the above.
Payment
Orders
placed on the site can be paid for by credit/debit card - please select
the World Pay option and you will be transferred to a secure area to complete
the transaction.
Alternatively,
it is possible to order the goods on the site and pay by credit/debit
card over the telephone or by cheque. Please note that we can only accept
payment by Visa, Mastercard or Switch over the telephone but a wider choice
of cards, including American Express, are available via online payment
using the World Pay option.
If
you would prefer to pay by cheque (GB Pounds only), please send either
a copy of the order placed on the site or a letter detailing the items
that you would like, your full postal address and a daytime contact telephone
number.
Cheques
should be made payable to "Curtain Poles Direct" and should
include the total cost, including any relevant shipping charges, e.g.
Northern Ireland. (These can be found on the Terms and Conditions page.)
We
will call you on receipt of the order and cheque to confirm the cheque
guarantee card details. We require the cheque guarantee card details to
process the cheque. Please call us on 0208-683-6466 if we do not contact
you within a few days, to ensure that we have received your order.
If
you would like to order goods not yet shown on our site (such as drapery
arms or portiere rods), this is possible by email, fax or post and payment
can be made by credit/debit card over the phone or by cheque - as detailed
above.
